These Terms & Conditions (“Terms”) govern your use of beyondbrainhealth.com and related Services offered by Beyond Brain Health, LLC, operating as Beyond Brain Health (“we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to use the Services. By using them, you represent that you are 18 or older.
2. Medical Disclaimer, No Medical Advice
The NSRI™ assessment, any reports, and all content on the Services, including articles, the podcast, and the book, are for general educational and informational purposes only. They do not constitute medical advice, diagnosis, or treatment.
The NSRI™ quantifies and identifies modifiable factors related to neurologic resilience. It does not diagnose any condition, and it does not predict, prevent, or guarantee any medical outcome. It is not a substitute for the advice of your physician or care team.
Using the Services does not create a physician–patient or other treatment relationship. Always consult a qualified professional before making medical decisions or changing your care. If you may be experiencing a medical emergency, call 911 or your local emergency number.
3. The NSRI™ Assessment and Reports
Your assessment results and any report depend on the information you provide and reflect a point-in-time educational analysis. We do not warrant that results are complete, accurate for your situation, or suitable for any particular purpose.
4. Accounts
If you create an account or use the client portal, you are responsible for your login credentials and for activity under your account. Provide accurate information and keep it current.
5. Purchases, Pricing, and Payment
Prices and availability may change. Payments are processed by third-party processors, and you agree to their terms. You are responsible for applicable taxes. Specific products and programs may have additional terms presented at the point of sale.
6. Subscriptions, Automatic Renewal, and Refunds
If you purchase a subscription or any offering that renews automatically, we will disclose the renewal terms, billing frequency, and price before you buy and obtain your consent. You may cancel as described at checkout or by contacting us, and cancellation will be at least as easy as sign-up. Refunds, if any, follow the policy presented at purchase.
7. Dietary Supplements
Any dietary supplements we offer are not intended to diagnose, treat, cure, or prevent any disease, and related statements have not been evaluated by the U.S. Food and Drug Administration. Beyond Brain Health™, Neurologic Stress & Recovery Index™, NSRI™, Bottleneck Index™, HARP™, and BrainSafe Recovery™ are our trademarks. We grant you a limited, personal, non-transferable license to use the Services for their intended purpose. You may not copy, scrape, resell, or create derivative works from our content without our written permission.
11. User Content
If you submit content (such as comments or reviews), you grant us a non-exclusive, royalty-free, worldwide license to use it in connection with the Services, and you represent that you have the right to share it and that it is not unlawful.
12. Acceptable Use
You agree not to misuse the Services, including by violating law, infringing rights, attempting to disrupt or gain unauthorized access to our systems, or using automated tools to harvest data.

We are not responsible for third-party sites, products, or services linked from or integrated with the Services. Your use of them is at your own risk and subject to their terms.

15. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Beyond Brain Health, LLC and its officers, employees, and agents from claims arising out of your use of the Services or your violation of these Terms.
17. Dispute Resolution; Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules. To the extent permitted by law, you and we agree to resolve disputes through binding individual arbitration rather than in court, and you and we waive any right to participate in a class action or class-wide arbitration. You may opt out of arbitration by notifying us in writing within 30 days of first accepting these Terms. Nothing here prevents either party from seeking relief in small-claims court or injunctive relief for intellectual-property misuse.
18. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted with a new effective date, and your continued use means you accept them.
19. Miscellaneous
If any provision is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and us regarding the Services. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them.
